Pub Co # 1 LLC, 30 N Gould St, Suite R, Sheridan, WY, 82801 (“us”, “we”, or “our”) operates the https://www.valentine.us website (the “Service”), which allows users to purchase and stream video content.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
Purchases and Payments
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, and your billing address.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and (ii) that the information you supply to us is true, correct and complete.
The Service employs the use of third-party services for the purpose of facilitating payment and the completion of Purchases. The Service uses Stripe as the payment processor. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy and their respective privacy policies.
Payment Processor Compliance (Stripe)
You agree to comply with all terms, conditions, agreements, and policies set forth by our payment processor, Stripe. You acknowledge and agree that your use of the Service shall not involve any products, services, or activities that are prohibited by Stripe’s Prohibited Business categories. Violations of Stripe’s terms may result in the suspension or termination of your access to the Service and other remedies, which may include the forfeiture of paid access.
Content and License
The video content available on the Service is the sole property of Pub Co # 1 LLC and is protected by copyright and intellectual property laws.
Upon completing a Purchase for the stream, Pub Co # 1 LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and view the purchased video content via the Service’s video player for personal, non-commercial use only. The license granted is solely for the duration of the streaming session or as otherwise explicitly stated at the time of purchase.
Prohibited Uses
You agree not to:
- Download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content for any purpose without our prior written consent.
- Bypass, modify, defeat, or circumvent any of the Service’s security or technological measures designed to protect the content.
- Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service.
- Use the Service for any unlawful purpose or to solicit others to perform or participate in any unlawful acts.
Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Pub Co # 1 LLC does not warrant that the Service will function uninterrupted, secure or available at any particular time or location; that any errors or defects will be corrected; or that the Service is free of viruses or other harmful components.
Governing Law
These Terms shall be governed and construed in accordance with the laws of United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Changes to Terms of Service
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
